1.1 “Content” means all text, images, graphics, video, audio, documents, data, layouts, designs, code, interfaces, and other materials displayed or made available through the Site. The term includes the “look and feel” and arrangement of the Site.

1.2 “Services” means any real estate, property management, hospitality management, HoReCa, recreational area management, investment support, or related services described on the Site or offered by the Company, whether online or offline. Nothing on the Site obligates the Company to provide any Services unless and until a separate written agreement is executed.

1.3 “You” and “User” mean any person who accesses or uses the Site, including on behalf of an entity. If you use the Site on behalf of an entity, you represent you have authority to bind that entity.

2.1 You confirm that you have legal capacity to accept these Terms under applicable law. If you are not of legal age or otherwise lack capacity, you must not use the Site.

2.2 The Site is not directed to children. We do not knowingly solicit or collect personal data from children.

2.3 We may restrict access to the Site (in whole or in part) at any time, including to enforce these Terms or to comply with law.

3.1 We may withdraw, amend, suspend, or discontinue the Site, any Content, or any functionality at any time, with or without notice. We are not liable if the Site is unavailable for any period or for any reason.

3.2 You are responsible for obtaining and maintaining all devices, software, and network connectivity needed to access the Site. You are responsible for all charges by your telecommunications providers.

3.3 If the Site includes areas that require registration or authentication, you are responsible for safeguarding credentials and for all activity conducted under your credentials. You must notify us promptly of any suspected unauthorized access.

4.1 We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site solely for lawful, personal, or internal business informational purposes.

5.2 Any trademarks, service marks, trade names, logos, and brand features displayed on the Site are the property of the Company or their respective owners. You must not use them without prior written authorization.

5.3 Any rights not expressly granted to you are reserved by the Company.

6.1 If you submit or upload any information, feedback, materials, or content through the Site or via social media interactions tied to the Site (“Submissions”), you grant the Company a worldwide, perpetual, irrevocable, royalty-free, transferable license to use, copy, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Submissions in any media, without compensation to you, to the extent permitted by law.

6.2 You represent and warrant that you own or control all rights in your Submissions and that your Submissions do not violate law, infringe third-party rights, contain malware, or include unlawful, defamatory, or abusive content.

6.3 We may remove Submissions at our discretion. We may cooperate with law enforcement or comply with legal requests related to Submissions where required.

7.1 The Site may contain links to third-party websites or services. These links are provided for convenience only and do not constitute endorsement or verification by us.

7.2 Your use of third-party websites is at your own risk and subject to their terms and policies. We are not responsible for third-party content, availability, security, or practices.

8.1 The Site is provided for general informational purposes. Content may describe projects, concepts, operational approaches, or future plans, and may be updated without notice.

8.2 You acknowledge that any reliance on the Site Content is at your own risk. You should obtain independent professional advice where appropriate.

10.2 To the fullest extent permitted by law, our total aggregate liability arising out of or related to the Site or these Terms shall not exceed the amount paid by you to us for access to the Site, if any, during the twelve (12) months preceding the event giving rise to liability. If you have paid no amounts, the cap is zero to the extent permitted by law.

10.3 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11.1 You agree to indemnify and hold harmless the Company and its officers, directors, employees, contractors, and agents from and against any claims, demands, losses, liabilities, costs, and expenses (including reasonable professional fees) arising from or related to your breach of these Terms, your unlawful use of the Site, or your Submissions.

11.2 We may assume control of the defense of any matter subject to indemnification, and you agree to cooperate as reasonably requested.

12.1 Your use of the Site may be subject to our Privacy Policy, which describes how we collect, use, and disclose personal information. The Privacy Policy is incorporated by reference into these Terms.

12.2 If a Privacy Policy page is published on the Site, the “last updated” date stated there applies. A privacy policy of similar structure is used by Anthem and we are aligning format accordingly.

13.1 We may update these Terms at any time by posting a revised version on the Site. Continued use of the Site after posting constitutes acceptance of the revised Terms.

13.2 If required by applicable law, we may provide additional notice of changes. Unless otherwise stated, changes are effective upon posting.

14.1 We may suspend or terminate your access to the Site at any time if we reasonably believe you have breached these Terms or if we must do so to comply with law.

14.2 Sections that by their nature should survive will survive termination, including Intellectual Property, Disclaimers, Liability Limitation, Indemnity, Governing Law, and Contact provisions.

15.1 These Terms and any dispute or claim arising from or related to them or the Site shall be governed by the laws of the Kyrgyz Republic, without regard to conflict-of-law rules.

15.2 You consent to the jurisdiction of the competent state courts of the Kyrgyz Republic, with venue in Bishkek, unless mandatory law provides otherwise.

15.3 We may seek injunctive or urgent legal relief in any competent jurisdiction where necessary to protect our rights, intellectual property, or confidential information.

16.1 If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.

16.2 No waiver is effective unless in writing. Failure to enforce any provision is not a waiver of future enforcement.

16.3 These Terms constitute the entire agreement between you and the Company regarding the Site and supersede prior understandings about Site use.

16.4 You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms to an affiliate or successor in connection with reorganization or asset transfer.
